Estos son los detalles muy resumidos de un caso demasiado largo:<\/p>\n<p>-El 6 de enero 2017, Waterkeepers puso una denuncia ante el Ministerio de Salud.<\/p>\n<p>-El 25 de enero 2017, el Ministerio inspeccion\u00f3 el lugar e hizo tinciones con fluoresce\u00edna, pero el tinte no sali\u00f3, lo que indicar\u00eda que las aguas negras y grises est\u00e1n siendo tratadas adecuadamente solo que su disposici\u00f3n no es correcta. Adem\u00e1s, se encontr\u00f3 que el sistema de tratamiento de aguas residuales no cuenta con permiso de ubicaci\u00f3n. En febrero 2017, se orden\u00f3 dejar de verter las aguas de las duchas y del tratamiento de los filtros de la piscina, adem\u00e1s de solucionar el estancamiento de aguas en la propiedad.<\/p>\n<p>-El 8 de marzo 2017, Selina present\u00f3 documentaci\u00f3n para responder a esas \u00f3rdenes sanitarias. Esta documentaci\u00f3n no era conforme a lo solicitado y se les solicita mejorarla.<\/p>\n<p>-En 6 de julio 2017 se les deniega el permiso de ubicaci\u00f3n de la planta de tratamiento (solicitado en junio) por no cumplir con los retiros. Selina aduc\u00eda que su planta de tratamiento es un \u201ctanque s\u00e9ptico\u201d que tiene menores requerimientos de retiro que una planta de tratamiento. Luego de un ir y venir de documentos en discrepancia de criterios (Selina ganando tiempo), el 21 de agosto se les indica que cuentan con 10 d\u00edas para tramitar el visto bueno de ubicaci\u00f3n.<\/p>\n<p>-El 28 de setiembre 2017, Selina solicita una pr\u00f3rroga del plazo aduciendo que, por ser un establecimiento construido, no aplica la solicitud de visto bueno de ubicaci\u00f3n, ni el visado de planos. El an\u00e1lisis de esta documentaci\u00f3n va a otros niveles del Ministerio de Salud y se pierde mucho tiempo en esto.<\/p>\n<p>-Al no haber resoluci\u00f3n de la situaci\u00f3n, en enero 2018, Waterkeepers eleva el caso al Tribunal Ambiental.<\/p>\n<p>-El 28 de febrero 2018, el Ministerio ordena que deben de cumplir con el retiro de linderos de 10m pues la construcci\u00f3n no corresponde con los planos visados originalmente.<\/p>\n<p>-El 9 de marzo 2018, el Ministerio les ordena presentar un plan remedial con cronograma de actividades, con un plazo de 8 meses (improrrogables).<\/p>\n<p>-El 15 de marzo presentan un plan al que se le encontraron inconformidades. Lo corrigen y a\u00fan no cumple. Luego de un va y viene de documentos, es hasta el 10 de abril es que se acepta el plan de acciones correctivas.<\/p>\n<p>-El 10 de abril se les ordena no usar la lavander\u00eda. Sin embargo, en dos visitas posteriores se comprob\u00f3 que la lavander\u00eda segu\u00eda en uso.<\/p>\n<p>Es decir, <strong>Selina tiene plazo hasta diciembre<\/strong> de este a\u00f1o para cumplir con su plan correctivo y solucionar la situaci\u00f3n. Esto es un resumen de much\u00edsimas inspecciones, visitas para tinci\u00f3n, reuniones y an\u00e1lisis del caso realizados por el Ministerio de Salud en oficinas de variados niveles.<\/p>\n<p>Lo m\u00e1s <strong>fastidioso<\/strong> de este caso es que Selina, en vez de hacer las cosas bien desde el principio, resolver sus faltas y funcionar adecuadamente, trat\u00f3 de ganar tiempo y hacer aceptar sus argumentos haciendo perder tiempo y recursos al Ministerio de Salud -que cuenta con recurso humano limitado y muchos casos de contaminaci\u00f3n, entre muchas otras cosas que atender- mientras siguen manejando inadecuadamente sus aguas residuales. Ya desde la primera vista del Ministerio de Salud en enero 2017 se sab\u00eda lo que se deb\u00eda hacer para cumplir, <strong>\u00bfpor qu\u00e9 no lo hicieron de una vez?<\/strong><\/p>\n<p>Se tiene muy claro que cosas como esta no solo pasa en Selina, pasa en muchos lugares del pueblo (demasiados dir\u00eda yo) con inclusive peores tipos de contaminaci\u00f3n. El caso de Selina es uno de los m\u00e1s notorios pues es el hotel que tiene mayor capacidad de hospedaje en la zona y por ende mayor cantidad de aguas servidas. Deber\u00edamos todos ver hacia adentro y analizar si estamos cumpliendo en nuestra casa y negocio. No esperemos a que nos vengan a inspeccionar, arregl\u00e9moslo de una vez; por su bien y el de la comunidad.<\/p>\n<p>Estamos en una comunidad que vive del turismo que viene atra\u00eddo a la belleza de los recursos naturales, la playa y las olas de la zona. Si lo analizamos desde un punto de vista econ\u00f3mico solamente, \u00bfqu\u00e9 sentido tiene destruir los recursos naturales que atraen a la fuente de ingresos del pueblo?<\/p>\n<p>A la reuni\u00f3n del viernes solo fue una persona de Waterkeepers, probablemente la \u00fanica persona que, por haber puesto las denuncias ante el Ministerio de Salud y el Tribunal Ambiental, tiene la informaci\u00f3n detallada y conoce bien el caso. Qu\u00e9 curioso, \u00bfno? Tanta gente hablando y tan poca inform\u00e1ndose. Buscando posibles explicaciones a esto podr\u00edamos decir que un viernes a las 6pm talvez no sea el mejor d\u00eda y hora para convocar a una reuni\u00f3n. Talvez tambi\u00e9n puede ser que la comunidad no quiere recibir informaci\u00f3n sino una soluci\u00f3n definitiva a un problema que existe desde que Selina abri\u00f3 en Santa Teresa. Sabemos tambi\u00e9n que a la comunidad le gusta mucho opinar, pero le cuesta mucho hacer.<\/p>\n<p>Creo que de todo esto deber\u00edamos preguntarnos de forma general: <strong>\u00bfPor qu\u00e9 esperamos a que nos reprendan para hacer las cosas bien? \u00bfPor qu\u00e9 no nos informamos y hacemos las cosas bien desde el inicio?<\/strong><\/p>\n<p>La naturaleza nos permite vivir en ella, es responsabilidad de todos el aprovechar de la mejor forma los recursos naturales que nos da, contaminando lo menos posible. \u00bfCu\u00e1ndo ser\u00e1 que nos vamos a dar cuenta de esto y hacer nuestra parte?<\/p>\n<p style=\"text-align: center;\">&#8230;*&#8230;<\/p>\n<p><strong>So, what\u2019s going on at Selina?<\/strong><\/p>\n<p>Since the opening of Selina Santa Teresa, Waterkeepers has been following up on their wastewater management issues. Here\u2019s a summary of the many details on this very long case:<\/p>\n<p>-January 6<sup>th<\/sup>, 2017, Waterkeepers files a claim before the Ministry of Health regarding Selina&#8217;s wastewater management deficiencies.<\/p>\n<p>&#8211; January 25<sup>th<\/sup>, 2017, the Ministry of Health inspects the place, carries out fluorescein dye tests but the pigment doesn\u2019t come out visibly, meaning that black and grey waters are being properly treated but inappropriately disposed of. They notice that the wastewater treatment plant does not have the proper permits regarding its location. On February 2017, the Ministry orders that they stop throwing the water from the pool\u2019s showers, as well as the pool\u2019s filter water unto the path, and that they solve the water stagnation issue at the property.<\/p>\n<p>-March 8<sup>th<\/sup> 2017, Selina submits the documents in response to these sanitary orders. This information was incomplete, so they were asked to improve it.<\/p>\n<p>-July 6th, 2017, Selina&#8217;s request for their treatment plant location permit was denied as it does not comply with the required distance from the neighbor\u2019s property. Selinas adduced that their treatment plant was in fact a septic tank (which would require less distance from neighboring properties). Back and forth of documents, discrepant opinions (Selina making time), on August 21<sup>st<\/sup>, they are told that they have 10 days to fix and get the location permit.<\/p>\n<p>-September 28th 2017, Selinas asks for an extension saying that, since the building already existed, they shouldn\u2019t need to ask for a location permit. The study of these documents escalates to other levels at the Ministry of Health and valuable time is lost doing so.<\/p>\n<p>-One year and still no solution, on January 2018, Waterkeepers escalates the claim before the Environmental Tribunal.<\/p>\n<p>-February 28<sup>th<\/sup>, 2018, the Ministry orders that they comply with the 10meter distance from the neighboring property.<\/p>\n<p>-March 9<sup>th<\/sup> 2018, the Ministry asks for a corrective plan with timeline to be carried out in no more than 8 months (non-extendable period).<\/p>\n<p>-March 15<sup>th<\/sup> 2018, Selina presents a plan which is found to be incorrect. They are asked to correct it and re-submit, which they do but it is still incomplete. Back and forth of documents, it isn\u2019t until April 10th that this plan is approved.<\/p>\n<p>-April 10<sup>th<\/sup> 2018, they are ordered not to use their washing machines. Nevertheless, they are found in two different occasions still using the washing machines.<\/p>\n<p>This all means that <strong>Selina has time until December 2018 to carry out their corrective plan and solve the situation<\/strong>. This is a very short summary of the many inspections, dyeing visits, meetings and case analysis done by the Ministry of Health at their offices at different levels.<\/p>\n<p>The most <strong>annoying<\/strong> thing about Selina&#8217;s case is that, instead of doing things right from the beginning, solve their issues, and operate accordingly, they tried to stall things trying to get away with their version of the facts, while still disposing of their wastewater inappropriately. This has made the Ministry of Health invest a lot of time and resources on this case and it\u2019s no secret that the Ministry of Health has limited human resources and has to deal with many other pollution cases, amongst the many other things they deal with. Since the Ministry\u2019s first visit to Selina on January 2017, they knew what needed to be done to amend their issues, <strong>why didn\u2019t they just solve it there and then?<\/strong><\/p>\n<p>It is clear that Selina&#8217;s is one of the many wastewater management cases in this town (too many I would say), some of them even more pollutant than this one. This is just very noticeable as Selina is the hotel with more lodging capacity, so with more wastewater to manage.<\/p>\n<p>We should all look within and see if we are doing it right in our homes and businesses. Let\u2019s not wait until they come inspect on us, let\u2019s just fix it once and for all, just because it\u2019s right. Is that too much to ask? It shouldn\u2019t be.<\/p>\n<p>We\u2019re in a community that lives out of tourism. Tourists come because of the beauty of the natural resources we have here. If we analyze this from a purely economic perspective, <strong>it is very stupid to destroy the town\u2019s source of income by polluting.<\/strong><\/p>\n<p>The only person at Friday\u2019s meeting was from Waterkeepers, probably the only person that had all the details and information about the case since we were the ones who presented the claims against them. Interesting uh. \u00a0So many people talking and no one informing themselves. Trying to find explanations to this, it\u2019s true that Friday 6pm is not the best time to call for a meeting. Also, people might not want to go and hear \u201cexplanations\u201d but just want a solution already to a very long case. And then there\u2019s also that people here love to comment but not many are so enthusiastic about doing.<\/p>\n<p>In a general way, let\u2019s just ask ourselves <strong>why do we wait until they come check on us to do the right thing? Why don\u2019t we just inform ourselves and do the right thing since the beginning?<\/strong><\/p>\n<p>Nature allows us to live within her, it is responsibility of all of us to use and enjoy the natural resources it gives us, polluting the least possible.
